By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1. Service Description

We provide a personalised gift creation service where users upload photographs, which are then edited using artificial intelligence (AI) technology, and printed onto physical products that are fulfilled and shipped by our third-party partner, Printful.

The Service includes:

  • Uploading photographic images to our platform
  • AI-powered editing and enhancement of your images
  • Printing your edited images onto selected products
  • Fulfillment and shipping of your personalised products

2. Age Restriction

You must be 18 years of age or older to use our Service.

Our Service uses Google’s Gemini 2.5 Flash Image API, which requires all users to be at least 18 years of age. By using our Service, you represent and warrant that you are at least 18 years old. We do not knowingly provide services to individuals under 18 years of age. Our Service is not directed toward or intended for use by minors.

If we discover that a person under 18 has provided us with personal information or used our Service, we will delete such information and terminate their access immediately.

3. AI Image Processing – Important Information

3.1 Third-Party AI Technology

Our Service uses Google’s Gemini 2.5 Flash Image API to edit and enhance your uploaded photographs. By using our Service, you acknowledge and agree that:

  • Your uploaded images will be transmitted to and processed by Google’s AI systems
  • The AI editing process is automated and uses experimental technology
  • Google may use your uploaded images and the AI-edited outputs to provide, improve, and develop Google’s products and machine learning technologies, consistent with Google’s Privacy Policy
  • Google takes steps to protect privacy, including disconnecting this data from identifiable information before human reviewers access it
  • You should not upload sensitive, confidential, or personal information you wish to keep completely private

3.2 AI-Generated Results

You acknowledge and accept that:

  • AI editing results are automatically generated and may vary in quality and outcome
  • Results may be inaccurate, unexpected, unsuitable, or different from what you anticipated
  • The technology is experimental and may occasionally produce unintended content
  • We make no guarantees about the specific artistic outcome of AI edits
  • AI-generated edits should not be relied upon without your own review and discretion
  • Similar or identical results may be generated for other users using similar images or prompts

3.3 No Professional Reliance

The AI editing service and generated content should not be relied upon for medical, legal, financial, professional, or any other form of advice. The Service is for personal, entertainment, and gift purposes only.

4. User Accounts

You may be required to create an account to use certain features of our Service. When you create an account, you must provide accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, false, or misleading.

5. Intellectual Property Rights and Uploaded Content

5.1 Your Content Ownership

You retain all ownership rights to your original photographs that you upload to our Service (“Your Content”).

5.2 Your Warranties and Representations

By uploading an image to our Service, you represent and warrant that:

  • You own the photograph OR have obtained all necessary rights, licenses, consents, and permissions to use and authorize us to use the photograph
  • You have obtained explicit consent from any identifiable individuals appearing in the photograph to use their likeness for the purposes of this Service
  • Your Content does not infringe or violate any third party’s copyright, trademark, patent, trade secret, moral rights, privacy rights, rights of publicity, or any other intellectual property or proprietary right
  • Your Content complies with all applicable laws and regulations

5.3 License You Grant to Us

By uploading Your Content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to:

  • Reproduce, store, and process your photograph
  • Transmit your photograph to Google’s Gemini AI API for editing and processing
  • Allow Google to use your photograph in accordance with Google’s Terms of Service and Privacy Policy
  • Create derivative works (AI-edited versions) from your photograph
  • Transmit the edited photograph to Printful for printing and fulfillment
  • Use your photograph for quality control, customer service, and dispute resolution purposes
  • Retain your photograph for as long as necessary to fulfill your order and comply with legal obligations

This license terminates when Your Content is deleted from our systems in accordance with our data retention policy, except where we are required to retain it for legal or regulatory purposes.

5.4 Prohibited Content

You must not upload images that contain or depict:

  • Nudity, sexually explicit content, or pornographic material
  • Violence, gore, or graphic content
  • Hate speech, harassment, or discriminatory content
  • Illegal activities or content that promotes illegal conduct
  • Content that infringes on any third party’s intellectual property rights, including:
    • Professional photography without the photographer’s permission
    • Stock photographs or images from image libraries
    • Artwork, illustrations, or designs created by others
    • Celebrity photographs or images of public figures taken by others
    • Brand logos, trademarks, or copyrighted designs
  • Images of minors without verifiable parental or guardian consent
  • Deepfakes or manipulated images intended to deceive or misrepresent
  • Private or confidential information
  • Content that violates anyone’s privacy or publicity rights
  • Medical imagery for clinical or diagnostic purposes
  • Content intended to bypass safety filters or generate harmful outputs
  • Content that violates Google’s Prohibited Use Policy
  • Any other content that we determine, in our sole discretion, is inappropriate or objectionable

5.5 Content Review and Removal

We reserve the right, but have no obligation, to:

  • Review, monitor, or screen uploaded content
  • Reject, refuse to process, or remove any content at our sole discretion
  • Remove content that violates these Terms or applicable law
  • Terminate accounts that repeatedly violate these content policies

We do not pre-screen content, and you acknowledge that we are not responsible for user-generated content.

5.6 Ownership of AI-Edited Images

  • You retain ownership of your original uploaded photograph
  • The AI-edited version is created using Google’s proprietary AI technology and our proprietary editing prompts
  • We do not claim ownership of the specific AI-edited image generated for your order
  • However, we (and Google) may generate similar or identical edits for other users
  • You receive a personal, non-commercial, non-transferable license to use the AI-edited image printed on the physical products you purchase from us
  • You may not resell, redistribute, sublicense, or commercially exploit the AI-edited images or our AI editing service

5.7 Our Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, software, AI prompts, and editing workflows, is the property of Feather & Blend or its licensors and is protected by United Kingdom and international copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, distribute, or reproduce any of our content without written permission
  • Attempt to reverse engineer, decompile, or extract the underlying AI models or technology
  • Use our Service to develop competing services or AI models
  • Frame or mirror any part of our Service without our prior written authorization

6. Orders and Payment

6.1 Order Process

When you place an order:

  1. You upload your photograph
  2. You select your desired product and customization options
  3. Your image is processed through our AI editing system
  4. You review and approve the AI-edited preview (where applicable)
  5. You complete payment
  6. We transmit your order to Printful for printing and fulfillment

6.2 Order Acceptance

Your order constitutes an offer to purchase. We reserve the right to accept or reject any order for any reason, including but not limited to:

  • Product availability
  • Errors in pricing or product information
  • Content that violates these Terms
  • Images unsuitable for AI processing or printing
  • Suspected fraudulent activity

We will notify you if we reject your order, and we will not charge you if we reject your order before processing.

6.3 Pricing and Payment

  • All prices are displayed in GBP and include VAT
  • Prices are subject to change without notice
  • Payment is due at the time of order placement
  • We accept credit and debit cards, Shopify SHOP pay and Paypal
  • You must provide accurate payment information
  • By providing payment information, you authorize us to charge the total order amount

6.4 Taxes

You are responsible for any applicable taxes, duties, or customs charges associated with your order. Prices displayed may or may not include VAT depending on your location. Additional charges may apply for international orders.

7. Production and Shipping

7.1 Fulfillment Partner

All products are printed and fulfilled by Printful, our third-party fulfillment partner. By placing an order, you acknowledge that:

  • Printful is responsible for printing, packaging, and shipping your product
  • We act as an intermediary between you and Printful
  • Your order information is transmitted to Printful for fulfillment
  • Printful’s production and shipping standards apply to your order

7.2 Production Time

Estimated production times are provided at the time of order and typically range from 2-7 business days. These are estimates only and not guarantees. Actual production times may vary based on:

  • Product type and complexity
  • Order volume
  • Printful’s production capacity
  • Unforeseen circumstances

7.3 Shipping

  • Shipping times are estimates and begin after production is complete
  • Shipping costs are calculated at checkout based on your location and selected shipping method
  • We are not responsible for delays caused by shipping carriers, customs, or circumstances beyond our control
  • You are responsible for providing an accurate shipping address
  • We are not responsible for orders shipped to incorrect addresses provided by you

7.4 International Shipping

For international orders:

  • Additional customs duties, taxes, or import fees may apply and are your responsibility
  • Customs clearance procedures may cause delivery delays
  • Some products may not be available for shipping to certain countries

7.5 Risk of Loss

Risk of loss and title for products pass to you upon delivery to the shipping carrier.

7.6 Tracking

Where available, tracking information will be provided once your order ships. We are not responsible for lost or stolen packages that show as delivered by the carrier.

8. Product Quality and Color Accuracy

8.1 Product Quality

We strive to provide high-quality products, but you acknowledge that:

  • Print quality may vary slightly between orders due to the nature of print-on-demand manufacturing
  • Colors may vary slightly from what you see on your screen due to differences in monitor calibration, screen settings, and printing processes
  • AI-edited images may not translate perfectly to physical products
  • Minor variations in printing are normal and do not constitute defects

8.2 Color Disclaimer

We make no guarantees regarding exact color matching between:

  • Your original image and the AI-edited version
  • What you see on your screen and the printed product
  • Multiple orders of the same product

9. Returns, Refunds, and Cancellations

9.1 Personalised Products

Because all products are custom-made and personalized to your specifications, we generally do not accept returns or offer refunds except as outlined below.

9.2 Cancellations

  • Orders may be cancelled within 12 hours of placement, before production begins
  • Once production has begun, orders cannot be cancelled
  • To request a cancellation, contact us immediately at refunds@featherandblend.co.uk
  • Refunds for successful cancellations will be processed within 3 business days

9.3 Defective or Damaged Products

We will provide a refund, replacement, or reprint if:

  • The product arrives damaged during shipping
  • There is a manufacturing defect in the product
  • We made an error in printing (wrong product, wrong image, incorrect customization)
  • The print quality is significantly below acceptable standards (not minor variations)

9.4 Non-Refundable Situations

We do not provide refunds for:

  • Dissatisfaction with the AI-edited result if you approved the preview
  • Minor color variations between screen and print
  • Normal print variations inherent to print-on-demand
  • Buyer’s remorse or change of mind
  • Incorrect shipping address provided by you
  • Products lost or stolen after delivery confirmation
  • Delays in shipping caused by carriers or customs

9.5 Defect Claims Process

To report a defective or damaged product:

  1. Contact us at refunds@featherandblend.co.uk within 3 days of delivery
  2. Provide your order number and clear photographs showing the defect or damage
  3. We will review your claim within 3 business days
  4. If approved, we will offer a reprint, replacement, or refund at our discretion

9.6 Refund Processing

Approved refunds will be processed within 3 business days and issued to your original payment method. Please allow additional time for your financial institution to process the refund.

10. Your Responsibilities and Indemnification

10.1 Your Responsibilities

You agree to:

  • Provide accurate information when creating your account and placing orders
  • Comply with all applicable laws and regulations when using our Service
  • Not use the Service for any unlawful purpose
  • Not upload content that violates these Terms
  • Not attempt to bypass, disable, or interfere with security features or safety filters
  • Not attempt to reverse engineer or extract our AI technology or processes
  • Not use the Service to develop competing AI models or services

10.2 Indemnification

You agree to indemnify, defend, and hold harmless Feather & Blend, Google, Printful, and our respective officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including attorney’s fees) arising from:

  • Your uploaded content and any breach of your warranties regarding that content
  • Your violation of these Terms
  • Your violation of any third party’s rights, including intellectual property rights, privacy rights, or publicity rights
  • Your violation of any applicable law or regulation
  • Your breach of Google’s Terms of Service or Prohibited Use Policy
  • Any use or misuse of the AI-edited images you receive

11. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Any warranties regarding the accuracy, reliability, or quality of the Service
  • Any warranties that the Service will be uninterrupted, timely, secure, or error-free
  • Any warranties regarding the results obtained from the AI editing service
  • Any warranties regarding the quality, accuracy, or suitability of AI-generated content

We do not warrant that:

  • The Service will meet your requirements or expectations
  • AI-edited images will be suitable for your intended purpose
  • Defects will be corrected
  • The Service or servers are free from viruses or harmful components

THE AI EDITING SERVICE USES EXPERIMENTAL TECHNOLOGY AND MAY PRODUCE INACCURATE, UNEXPECTED, OR UNSUITABLE RESULTS. YOU USE THE SERVICE AT YOUR OWN RISK.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FEATHER & BLEND, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Loss of business opportunity
  • Damage to reputation
  • Cost of substitute goods or services
  • Any damages arising from your use or inability to use the Service
  • Any damages arising from AI-edited results or printed products
  • Any damages arising from delays, errors, or failures in production or shipping
  • Any damages arising from third-party actions (including Google and Printful)

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM, OR £100, WHICHEVER IS LESS.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

13. Third-Party Services

13.1 Google Gemini API

Our Service utilizes Google’s Gemini 2.5 Flash Image API. Your use of our Service is also subject to Google’s applicable terms of service and policies. We are not responsible for Google’s services, policies, or any changes Google makes to its API or terms.

13.2 Printful

Our fulfillment services are provided by Printful. While we select and work with Printful, we are not responsible for:

  • Printful’s manufacturing processes or quality standards
  • Delays caused by Printful’s production or shipping
  • Printful’s errors or failures
  • Changes to Printful’s services or policies

13.3 Payment Processors

We use third-party payment processors to process payments. Your payment information is subject to the payment processor’s privacy policy and terms of service.

13.4 No Endorsement

We do not endorse and are not responsible for the content, products, services, or practices of any third parties. Your interactions with third parties are solely between you and the third party.

14. Data Protection and Privacy

15. Copyright and DMCA

If you believe content you uploaded was wrongly removed, you may file a counter-notice containing the information required under applicable law.

15.4 Repeat Infringers

We will terminate the accounts of users who are repeat copyright infringers.

16. Prohibited Uses and Safety Features

16.1 Safety Features

The AI editing service includes safety features designed to block harmful content. You must not:

  • Attempt to bypass, disable, or circumvent these safety features
  • Intentionally create prompts or upload content designed to evade content filters
  • Lower safety settings inappropriately (where applicable)
  • Use the Service in any way that could harm, disable, or impair the Service

16.2 Prohibited Activities

You may not use the Service to:

  • Violate any laws, regulations, or these Terms
  • Infringe on intellectual property or other rights of others

  • Uploading prohibited content
  • Fraudulent or illegal activity
  • At our sole discretion for any other reason

17.3 Effect of Termination

Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account and content
  • Pending orders may be cancelled without refund if termination was due to your breach
  • Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability

19.3 Informal Resolution

Before filing any formal claim, you agree to first contact us at refunds@featherandblend.co.uk to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith.

19.4 Time Limitation

Any claim or cause of action arising out of or related to the Service must be filed within one (1) year after the claim or cause of action arose, or it shall be forever barred.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and Feather & Blend regarding the Service, and supersede all prior or contemporaneous understandings and agreements, whether written or oral.

23. Assignment

You may not assign or transfer these Terms or your rights and obligations under these Terms without our prior written consent. We may assign or transfer these Terms or our rights and obligations without restriction, including to any successor or acquirer.

24. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, natural disasters, pandemics, government actions, internet or telecommunications failures, or failures by Google or Printful.

25. Consumer Rights

25.1 UK Consumer Rights

If you are a consumer in the United Kingdom, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation.

25.2 Right to Cancel (Distance Selling)

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you may have a right to cancel your order within 14 days. However, this right does not apply to:

  • Goods that are made to your specifications or clearly personalized (which applies to our products)
  • Sealed goods which are not suitable for return due to health or hygiene reasons, once unsealed

Because all our products are custom-made and personalized, you acknowledge that the cancellation right does not apply once production has begun, in accordance with applicable law.
